POLICY TERMS AND CONDITIONS
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ORDERING GOODS FROM GRATIFY.
The terms and conditions below form the contract between GRATIFY and the buyer. Your order of goods is confirmation of your acceptance and agreement with these terms and conditions and to be legally bound by them. GRATIFY is not obliged to accept your offer to purchase goods.
'You' and 'Buyer' means the person(s) organisation or company that buys the goods from us and ‘Your' shall be interpreted accordingly.
- ‘GRATIFY' shall mean 'GRATIFY.CO.NZ LIMITED' and/or its parent company.
- 'Us' and 'We' both mean 'GRATIFY' and 'our' shall be interpreted accordingly.
- The 'Terms and Conditions' forming the policy detailed herein shall be governed by New Zealand law and any disputes shall be settled in accordance with New Zealand law.
- 'Goods' and 'Products' shall mean any goods that GRATIFYsupplies under the terms and conditions of contract detailed herein.
- 'Contract' means any contract between you and us, for the sale and purchase of goods which incorporates these terms and conditions.
- 'Website' shall mean http://www.GRATIFY.co.nz
- 'Day' shall mean working or business day and days shall be interpreted accordingly.
- ‘Buyer’ shall mean the person(s), organisation or Company that buys goods from GRATIFY.
- - Reference to any statute or statutory provision refers to its most recent version
- - Reference to the singular includes the plural and vice versa
- - Headings are used only for convenience
DESCRIPTION OF GOODS
GRATIFY takes care to accurately describe and display products and colours on our website. However, colours and products displayed on our website may look different to the actual product.
GRATIFY will endeavor to accurately describe and portray goods but takes no responsibility for errors. Pictures, descriptions, specifications or advertising will not form part of the contract. If the goods requested are not available we will provide substitutes.
If you are not happy with the substitute goods we will accept the return of goods. Reference should be made to our Returns and Exchange Policy below.
SHIPPING & DELIVERY
Goods are shipped out within 1 (one) day of payment receipt subject to product availability and Credit Card Verification. Allow 48 hours for other payment options such as Bank deposit or Internet banking. Saturday delivery is by special request and will require special payment. Goods will be delivered by post or courier to the address provided on the order form. Any delivery date given by us will be an estimate and we will not be liable for any costs, damages, charges or other expenses caused by late delivery. If the goods cannot be delivered or you will not accept delivery for whatever reason and:-
1. All risk in the goods will pass to you
2. The goods will be deemed to have been delivered
3. We may store the goods until you are able to take delivery at your cost.
GRATIFY will not be liable for any proven non delivery to you. Our liability for non delivery of goods is limited to providing you with details of the shipment. We are not responsible for loss or damage to goods that are delivered to an incorrect address. GRATIFY will not deliver to P O Box or any address which we deem suspicious. We ship our goods by post or Courier service within New Zealand. Should you feel that your goods do not arrive in good condition, please feel free to contact us at contact@GRATIFY.co.nz. GRATIFY will be deemed to have delivered the goods when passed to the post or courier service for delivery to you.
All prices for goods are quoted in New Zealand Dollars and include GST. Prices are subject to change without notice. The cost of delivery is shown and included in the final price.
Payment may be made by any of the methods shown on our website. Including Credit Card (Visa or MasterCard), Bank Deposit and Internet banking.
We will ship goods to you once your payment has been cleared to our account by our bankers. GRATIFY reserves the right to conduct a fraud check with our bankers prior to shipment of products. GRATIFY may require additional information for large orders.
RETURNS & EXCHANGES
Please email contact@GRATIFY.co.nz in the first instance for follow up on all orders quoting your order number. Notify us within 2 days if you have not received your order or if it is damaged
GRATIFYis committed to providing and delivering top quality products and services to our customers. We welcome the return and exchange of a product that has a manufacturer defect or damaged while in transit, providing the following conditions are met:
We do not give a refund if you change your mind about a product.
- · You should notify us within 2 days of receipt by email at contact@GRATIFY.co.nz and include your order number as a reference. Returns notified after 2 (Two) days of receipt cannot be accepted.
- · Returned goods must be in their original packing and not damaged or altered in any way and the contents must be in their original resalable condition. We will not accept returned goods that have been opened or used for health and hygiene reasons.
- · All products being returned must be shipped by courier with a tracking number. Returns of items that may be classed as hazardous goods require special handling. GRATIFYwill not pay any return shipping cost, therefore shipping charges on exchanged or returned products are payable by you
- · Damaged items while in transit must be returned via NZ Couriers (0800 800 841) in original packaging of the product and original courier package. For lost items, you must notify us immediately if you haven’t received the package within 2 days by 5 pm.
- · A copy of the invoice must be included in all returns.
- · Your address and telephone number should be clearly and correctly stated in case we need to contact you.
We will credit your online shopping account for returned products and give you a coupon code for future purchase. Any credits to your GRATIFY online shopping account will be made within 7 working days of receiving the returned item and will be valid for 3 months.
We will not credit return shipping charges.
We will not give cash refunds for returned products.
Damaged items while in transit will be replaced within 14 – 21 days.

This Returns and Exchanges policy applies to all internet/salon and telephone orders.

GRATIFY respects the privacy needs and concerns of our customers. We will not obtain personally identifying information about you unless you choose to provide such information to us voluntarily, whether at our salon, online, through mail order or other promotional activities. Because our customers are of vital importance to us, we do not participate in bulk email solicitations which you have not consented to receiving (i.e., "spam").
Collection of your information; Instances where personally identifiable information may be gathered include registrations (for example, registration on our website) and at our salon or by mail order. The types of personally identifying information we collect may include contact information (e.g., name, postal address, email address and phone number) and information about your hair care preferences, as well as other relevant information. When you visit us online, we also may collect certain non-personally identifiable information, such as the type of browser you are using, the domain name of your Internet service provider, which of our pages you access, how long you spend on each page, and aggregate data about the number of visits you make and the products and services in which you are interested. The information we learn from you during your visit helps us to improve our site, respond to your requests and customize your shopping experience with GRATIFY. We use the personally identifiable information you provide to respond to any of your questions about our products and services. Also, we employ other companies and individuals to perform functions on our behalf. Examples include website hosting and development, fulfilling orders, delivering packages, sending postal mail and e-mail, removing repetitive information from customer lists, analyzing data, providing marketing assistance, and processing credit card payments. They have access to personal information needed only to perform their functions. We require companies with whom we contract for outsourced services to keep data received from us confidential and to use it only for the purposes indicated. We may, from time to time, supplement the information we collect with outside records to enhance our ability to serve you, to tailor our content to you, and to offer you opportunities to purchase products or services that we believe may be of interest to you. As required by law we may release personally identifying information when we believe release is appropriate to comply with law or legal process (e.g. in response to a court order) or to protect the rights or property of GRATIFY, our users, our partners or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. In addition, in the event that all or substantially all of GRATIFY stock and/or assets are transferred or sold to another entity, we may transfer personally identifiable information to the acquiring entity.
Security; Your privacy and security are very important to us, GRATIFYuses the best security available for on-line purchasing. When you click the "Add to Shopping Cart" button, GRATIFYautomatically checks to see that you have a secure connection. GRATIFY uses Secure Sockets Layer (SSL), an encryption technology that works with the following browsers: Netscape Navigator, Microsoft Internet Explorer, and AOL (America Online). If your browser does not support SSL, you will need to upgrade to a new version of Netscape Navigator, Internet Explorer, or AOL that does for on-line purchases. Or, you may fax, mail or phone in your order. As part of GRATIFY privacy and security practices, we do not store your credit card number in your membership file or order history. We request you kindly provide us with your credit card number every time you make a secure transaction.
GOODS AND SERVICES TAX (GST)
GRATIFY is required by law to charge GST on all purchases made in New Zealand at a current rate of 15%.
If we are unable to carry out our business due to circumstances beyond our control we may reduce the volume of goods shipped, cancel delivery, or cancel the contract. Such circumstances include acts of God, Government actions, war, embargo, national emergency, fire, explosion, acts of terror, lock outs, flood, fire, epidemic etc. If the circumstances in question continue for a continuous period of more than 10 days you may give us written notice to cancel the contract.
Due to the lack of control we have over application and operation procedures for the use of glue, glue guns and other application tools, GRATIFY cannot accept any responsibility whatsoever for any damage or injury caused to users of the products.
GRATIFY shall not be liable for any loss or profits, or any consequential, indirect or special loss, or damage, or loss of any kind, arising directly or indirectly from any breach of GRATIFY obligations under this contract or in tort. Where GRATIFY is liable to the buyer, the maximum cost of any liability shall not exceed the value of the goods, products or services provided to the buyer. GRATIFY accept no responsibility for the actions of the buyer or the buyer’s wrongful use of goods purchased from GRATIFY. We do not control, endorse or assume responsibility for any product, brand, method, treatment, information or services displayed on the website in any way.
Failure by GRATIFY to enforce any of the terms and conditions shall not be deemed to be a waiver of any of the rights or obligations GRATIFY has under the contract.
Product descriptions, typographic, pricing and photographic errors are unintentional and subject to correction. We regret, but are not liable for these errors.
GRATIFY supplies certain items with a warranty against failure. As warranty conditions and terms vary for different manufacturers and items we request you refer to the conditions attached with each purchase.
